Friedrich A. Hayek was one of the twentieth century’s greatest philosophers. While he is best known for his work in economics, he also made signifi cant contributions in political philosophy and law. The publication for which Professor Hayek is most widely known is The Road to Serfdom, written during World War II, the condensed Reader’s Digest version of which is presented here along with what might be seen as his follow-up, The Intellectuals and Socialism, fi rst published by the University of Chicago Law Review in 1949.
A focal point of The Road to Serfdom was to offer an explanation for the rise of Nazism, to correct the popular and erroneous view that it was caused by a character defect of the German people. Hayek differs, saying that the horrors of Nazism would have been inconceivable among the German people a mere fi fteen years before Adolf Hitler’s rise to power. Indeed, ‘throughout most of its history [Germany was] one of the most tolerant European countries for Jews’.1 Other evidence against the character defect argument is that the writings of some German philosophers, such as Johann Wolfgang von Goethe, Wilhelm von Humboldt and Friedrich Schiller, served as inspiration for ideas about the liberal order later expressed in the writings of British philosophers such as John Stuart Mill and David Hume.
What happened in Germany? Hayek explains, ‘The supreme tragedy is still not seen that in Germany it was largely people of good will who, by their socialist policies, prepared the way for forces which stand for everything they detest’. Hayek’s explanation for the rise of Nazism was not understood and appreciated in 1944, and it is still not fully understood and appreciated today. Collectivism, whether it is in Germany, the former Soviet Union, Britain or the USA, makes personal liberty its victim. How do we combat collectivism? Hayek provides some answers in The Intellectuals and Socialism. In a word or two, those who support the liberal social order must attack the intellectual foundations of collectivism. Hayek urges that an understanding of just what it is that leads many intellectuals toward socialism is vital. It is neither, according to Hayek, selfi sh interests nor evil intentions that motivate intellectuals towards socialism. On the contrary, they are motivated by ‘mostly honest convictions and good intentions’. Hayek adds that it is necessary to recognise that ‘the typical intellectual is today more likely to be a socialist the more he is guided by good will and intelligence’.

A professor of English (Univ. of Memphis) and obvious country music fanatic, Ching offers a study of the basis and social implications of "hard country." She begins by defining her subject as the Southern twang of angry alienation, hard times, and incurable desolation in contrast to the patriotism, nostalgia, and pop romance of mainstream country. She examines the desolate male fatalism of such stars as George Jones, Merle Haggard, and David Allen Coe, then turns to the roots of hard country with pioneer Hank Williams and his son, Hank Jr. Rather unconvincingly, Ching categorizes as "hard" the rock-inflected Bakersfield sound of Hee Haw regular Buck Owens and prot?g? Dwight Yoakam. She finishes with the rock-tinged, Hank Williams-obsessed outlaw country of the 1970s, discussing such singers as Willie Nelson and Waylon Jennings, and hints at the uncertain future of the music. Well organized, well researched, and largely free of academic jargon, the book conveys Ching's enthusiasm for the hard country sound and contributes some interesting, though misplaced, new material about Buck Owens. Recommended primarily for fans and scholars of country.

Taking as a starting point the widely accepted view that states confronted with terrorism must find a proper equilibrium between their respective obligations of preserving fundamental rights and fighting terrorism effectively, this book demonstrates how the design and enforcement of a human rights instrument may influence the result of that exercise. The book looks at the question of how a legal order's approach to the limitation of rights may shape decision-making trade-offs between the demands of liberty and the need to guarantee individual and collective security. Special attention is given to the difference between the adjudicative methods of balancing and categorization. The book challenges the conventional wisdom that individual rights, in times of crisis, are better served by the application of categorical rather than flexible models of limitation. In addition, the work considers the impact of a variety of other factors, including the discrepancies in enforcing an international convention as opposed to a national constitution and the use of emergency provisions permitting derogations from human rights obligations in time of war or a public emergency. Research questions are addressed through a comparative study of the terrorism-related restrictions on five fundamental rights protected under the European Convention on Human Rights and the US Constitution — the right to freedom of expression, the right to freedom of association, the right to personal liberty, the right to privacy, and the right to a fair trial. The book offers both a theoretical account of the paradoxical relationship between terrorism and human rights, and a comprehensive comparative survey of the major decisions of the highest courts on both sides of the Atlantic.

It is a very welcome addition to the literature on human rights and terrorism. Different readers will gain different things from a thought-provoking study.
