Anglo-American private law has been a far more complex phenomenon than has been usually recognized. Attempts to reduce it to a single explanatory principle, or to a precisely classified or categorized map, scheme, or diagram, are liable to distort the past by omitting or marginalizing material inconsistent with proposed principles or schemes. This study will be of importance to all who are interested in property, tort, contract, unjust enrichment, legal reasoning, legal method, the history of the common law, and the relation between legal theory and legal history.

Wszyscy zginęli z rąk Siuksów i Czejenów podczas bitwy nad rzeką Little Big Horn.

In the 1930s, swing music reigned, and the Jimmie Lunceford Orchestra was the hottest and hippest attraction on the black dance circuits. Known for its impeccable appearance and infectious rhythms, Lunceford's group was able to out-swing and outdraw any band. For ten consecutive years, they were the best-loved attraction at Harlem's famed Apollo Theater. The group's hit recordings sold in the hundreds of thousands, and Jimmie Lunceford's band rivaled Ellington's for popularity in the African American community.

Jimmie Lunceford was also an innovator, elevating big-band showmanship to an art and introducing such novel instruments as the electric guitar and bass. The band's arrangements, written by Sy Oliver, Edwin Wilcox, Gerald Wilson, Billy Moore, Jr., and Tadd Dameron, were daring and forward looking, influencing generations of big-band writers.

Rhythm Is Our Business traces the development of the Jimmie Lunceford Orchestra from its infant days as a high school band in Memphis to its record-breaking tours across the United States, Canada, and Europe. The book also unveils Lunceford's romantic yet ill-fated involvement with Yolande Du Bois, daughter of famous writer and opinion leader W.E.B. Du Bois. And by reconstructing Lunceford's last day, the book offers a glimpse into the mysteries surrounding the leader's untimely death. This is essential reading for anyone interested in the history and legacy of swing.

Eddy Determeyer has been a freelance music journalist for more than three decades. In 1984 Determeyer wrote a seven-part series on Jimmie Lunceford for the Dutch magazine Jazz Nu. Determeyer has written thousands of articles on music for a variety of Dutch publications and is the author of several books. He currently produces the Holiday for Hipsters radio show for Dutch station Concertzender.

Camille, which swept through coastal Mississippi and Louisiana in August 1969, was the storm that inspired the five-level scale currently used to predict the damage inflicted by hurricanes, and remains the only Category 5 storm—the strongest—to make landfall in modern American history. Zebrowski and Howard ground the storm's story in personal narratives, opening with the tale of a couple who fear their son has been killed when the storm hits the Mississippi coast. They interview other survivors in the region and up in Virginia, where Camille collided with another storm system, tracking the destruction and the confused response of local authorities. Zebrowski, a physicist, and Howard, a political columnist for a northern Louisiana newspaper, also focus on the role of Southern racial politics in shaping the civic response, particularly in one remote Louisiana parish. It's a serviceable recounting, with a thin layer of analysis discussing how Camille influenced the eventual creation of FEMA. Brief reference is made to Hurricane Katrina, but at this early stage, the authors can't say more than that authorities appear not to have learned from the earlier storm's effects.

The USS Carondelet had a revolutionary ship design and was the most active of all the Union's Civil War river ironclads. From Fort Henry through the siege of Vicksburg and from the Red River campaign through the Battle of Nashville, the gunboat was prominent in war legend and literature. This history draws on the letters of Ensign Scott Dyer Jordan and Rear Adm. Henry Walke's memoirs.

Nat Hentoff, renowned jazz critic, civil liberties activist, and fearless contrarian--"I'm a Jewish atheist civil-libertarian pro-lifer"--has lived through much of jazz's history and has known many of jazz's most important figures, often as friend and confidant. Hentoff has been a tireless advocate for the neglected parts of jazz history, including forgotten sidemen and -women. This volume includes his best recent work--short essays, long interviews, and personal recollections. From Duke Ellington and Louis Armstrong to Ornette Coleman and Quincy Jones, Hentoff brings the jazz greats to life and traces their art to gospel, blues, and many other forms of American music. At the Jazz Band Ball also includes Hentoff's keen, cosmopolitan observations on a wide range of issues. The book shows how jazz and education are a vital partnership, how free expression is the essence of liberty, and how social justice issues like health care and strong civil rights and liberties keep all the arts--and all members of society--strong.

Tort law is the body of law governing negligence, intentional misconduct, and other wrongful acts for which civil actions can be brought. The conventional wisdom is that the rules, concepts, and structures of tort law are neutral and unbiased, free of considerations of gender and race.
In The Measure of Injury, Martha Chamallas and Jennifer Wriggins prove that tort law is anything but gender and race neutral. Drawing on an in-depth analysis of case law ranging from the Jim Crow South to the 9/11 Victim Compensation Fund, the authors demonstrate that women and minorities have been under-compensated in tort law and that traditional biases have resurfaced in updated forms to perpetuate patterns of disparate recovery based on race and gender. Grappling with tort theory, the intricacies of legal doctrine and the practical effects of legal rules, The Measure of Injury is a unique treatise on torts that uncovers the public and cultural dimensions of this always-controversial domain of private law.

Hollywood has exerted a profound influence on British style and design. From its earliest days, Hollywood glamour in the form of make-up, hairstyles, and fashion was mimicked by women throughout Britain. But the influence of Hollywood was more than skin-deep. Nearly every form of British material culture in the twentieth century has been influenced to some extent by American style, disseminated through the medium of film to a broad and receptive market.

With the erection of the Chrysler Building in New York in the late 20s, representing the city and modern American urban life, the Manhattan skyline became an enduring icon in popular culture on both sides of the Atlantic. Not only Hollywood film, but jazz and American companies all combined to bring the new Moderne style to bear on Britain. The architecture of shops, cinemas, and factories all reflect this influence, as did various forms of transportation and the interiors of homes. Even as late as the consumer boom in the 80s, revivals celebrating the Moderne style were popular in Britain as well as abroad. This influence was naturally not without its critics. The very popularity of American design challenged the aesthetics and elitism of British high arts and remains controversial.

Anyone interested in design, material culture, film or architecture will find this book to be a lucid and absorbing exploration of a popular aesthetic.

John Gregory Bourke kept a monumental set of diaries as aide-de-camp to Brigadier General George Crook. This fourth volume (of a projected set of eight) chronicles the political and managerial affairs in Crook's Department of the Platte. A large portion centers on the continuing controversy concerning the forced relocation of the Ponca Indians from their ancient homeland along the Dakota-Nebraska line to a new reservation in the Indian Territory. An equally large portion concerns Bourke's ethnological work under official sanction from the army and the Bureau of Ethnology. Each volume in the series is extensively annotated and contains a biographical appendix on Indians, civilians, and military personnel named in the volume.

When bombs rained down on Pearl Harbor in 1941, Japanese American college students were among the many young men enrolled in ROTC and called upon to defend the islands against invasion immediately after the attack. In a matter of weeks, however, the military government questioned their loyalty and disarmed them.
In this book, Franklin Odo places the largely untold story of the war-time experience of these young men in the context of the community created by their immigrant families and its relationship to the larger, white-dominated society. At the heart of the book are vivid oral histories that recall the young men's service on the home front in the Varsity Victory Volunteers, a non-military group dedicated to public works, as well as in the segregated 442nd Regimental Combat Team that fought in Europe and the Military Intelligence Service. Odo shows how their war-time experiences and their post-war success in business and politics contributed to the simplistic view of Japanese Americans as a model minority in Hawai'i and glossed over significant differences in their lives and perspectives. No Sword to Bury is a book about a critical moment in ethnic identity formation among the first generation of Americans of Japanese descent (the nisei) as well as a history of their community during the war.

In 1852 Hannah Rebecca Crowell married sea captain William Burgess and set sail. Within three years, Rebecca Burgess had crossed the equator eleven times and learned to navigate a vessel. In 1856, 22-year-old Rebecca saved the ship Challenger as her husband lay dying from dysentery. The widow returned to her family's home in Sandwich, Massachusetts, where she refused all marriage proposals and died wealthy in 1917.
This is the way Burgess recorded her story in her prodigious journals and registers, which she donated to the local historical society upon her death, but there is no other evidence that this dramatic event occurred exactly this way. In The Captain’s Widow of Sandwich, Megan Taylor Shockley examines how Burgess constructed her own legend and how the town of Sandwich embraced that history as its own. Through careful analysis of myriad primary sources, Shockley also addresses how Burgess dealt with the conflicting gender roles of her life, reconciling her traditionally masculine adventures at sea and her independent lifestyle with the accepted ideals of the period’s “Victorian woman.

Stuart A. Scheingold's landmark work introduced a new understanding of the contribution of rights to progressive social movements, and it continues to stand out as a seminal and provocative book bridging political science and sociolegal studies. Since its original publication, a flourishing body of scholarship has been built on the foundations laid in the original volume. In his new preface, the author provides a cogent and constructive analysis of this new scholarship -- which constitutes the legacy of the first edition and the occasion for this thirtieth anniversary second edition. Malcolm Feeley of the Boalt Hall School of Law at the University of California, Berkeley, also contributes a new foreword tracing the intellectual roots of The Politics of Rights to the classic texts of social theory and sociolegal studies.

Texas singer/songwriter Vince Bell's story begins in the 1970s. Following the likes of Townes Van Zandt and Guy Clark, Bell and his contemporaries Lyle Lovett, Nanci Griffith, and Lucinda Williams were on the rise. In December of 1982, Bell was on his way home from the studio (where he and hired guns Stevie Ray Vaughan and Eric Johnson had just recorded three of Bell's songs) when a drunk driver broadsided him at 65 mph. Thrown over 60 feet from his car, Bell suffered multiple lacerations to his liver, embedded glass, broken ribs, a mangled right forearm, and a severe traumatic brain injury. Not only was his debut album waylaid for a dozen years, life as he'd known it would never be the same. In detailing his recovery from the accident and his round-about climb back on stage, Bell shines a light in those dark corners of the music business that, for the lone musician whose success is measured not by the Top 40 but by nightly victories, usually fall outside of the spotlight. Bell's prose is not unlike his lyrics: spare, beautiful, evocative, and often sneak-up-on-you funny. His chronicle of his own life and near death on the road reveals what it means to live for one's art.
